DSCA Relaxes Contingent Fee Limitation On FMF Contracts


DSCA has released its new FMF Guidelines and Certification & Agreement (dated January 2005) along the lines of the changes proposed in late 2003 (see Bullet Point dated Dec. 19, 2003). The contingent fee limitation -- despite opposition from the Israeli Mission in NY -- will no longer apply to contracts below the simplified acquisition threshold or to "commercial items sold at catalog or published prices," but contractors will be subject to a new requirement to furnish copies of relevant export licenses or a written certification that no license is required.
