Latest DoD "Reform" Act Is Far-Reaching


The procurement "reform" provisions of Title VIII of the 2008 DOD Authorization Act as reported in the Conference Report filed on December 6 are the most far-reaching in many years, including new restrictions on DOD use of schedule contracts, new rules (generally good news) about specialty metals, new rules about commercial services, new rules about justifying the commerciality of hardware, new rules about multiyear procurements, requirements for comprehensive audits of Iraq and Afghanistan contracts, new rules about award and protest of Task Orders under IDIQ contracts that include authority to protest Task Order awards in excess of $10M, annual public summaries of agency audit reports and for immediate release of such reports in response to congressional requests, new protections for contractor employees who provide information to Congress, new restrictions on employment of former senior DOD employees, new contractual requirements for security contracting, and requirements for studies and reports on many important subjects.
