Senior DOJ Official Discloses Uptick in Referrals to Antitrust Division’s New Procurement Collusion Strike Force

Last week a Senior Department of Justice official remarked that the Antitrust Division’s recently-formed Procurement Collusion Strike Force (PCSF) already has resulted in more activity than expected. The inter-agency PCSF was created to pursue bid-rigging and other criminal antitrust violations in government procurement settings. The official said the Antitrust Division has been much busier since the announcement of the PCSF in November 2019. It has opened several new grand jury investigations related to potential criminal conduct in public procurements based on referrals from federal procurement officers, local governments, and even fellow bidders. According to this official, the sentiment the Antitrust Division has been hearing from customers and other participants is that they knew there were some bad actors, “we just didn’t think anyone cared.”
