Supreme Court Strictly Enforces CFC Statute Of Limitation


The Supreme Court held in John R. Sand & Gravel v. Unites States (Jan. 8, 2008, that the special statute of limitations under the Tucker Act, which says that "'[e]very claim of which' the Court of Federal Claims 'has jurisdiction shall be barred' unless filed within six years of the time it first accrues," means what it says. No equitable tolling or waiver is permitted, and the court must raise the issue even when the parties do not.
