The “Internet of Things” has been described as the extension of the Internet to the physical world – sensors and actuators embedded in everyday devices to collect and share data via the Internet. Such technologies can offer significant consumer and commercial benefits, provided manufacturers design security and safety into the products from the start.

Launching interconnected products creates immediate litigation risks. For example:

  • Manufacturers have been hit with patent cases within days or weeks of launching interconnected wearable technology.
  • Security vulnerability can lead to FTC action, fines and onerous compliance obligations and may provide fodder for class action litigation.
  • Safety vulnerability may lead to recalls, and to product liability, warranty claims, and class action litigation. 

Furthermore, leveraging the data that these products collect while minimizing litigation and regulatory risks and protecting intellectual property and ownership rights presents both opportunities and challenges.

This panel will discuss the litigation risks presented by the Internet of Things and recommend best practices to minimize those risks when launching interconnected products for both consumer and industrial use.
