On June 22, 2016, President Obama signed into law the Frank R. Lautenberg Chemical Safety for the 21st Century Act. This legislation, which is intended to modernize the 40-year-old Toxic Substances Control Act (TSCA), completely overhauls the way that chemical products are regulated in the United States. Importantly, the New TSCA does not only affect chemical producers or importers. Any company that uses chemical products in its operations is potentially subject to regulation under this law.

Crowell & Moring played an active role in the legislative process leading up to enactment of TSCA reform, and the lawyers in our chemicals practice have decades of experience helping companies in various industry sectors understand and comply with their obligations under TSCA. We have established this TSCA resources page to provide our clients with an easy-to-access, centralized source for information about TSCA modernization and EPA’s implementation of the New TSCA. Among the resources that can be accessed here are:

  • Key Legislative Documents
  • Guidance Documents from EPA
  • Training Materials on the New TSCA
  • Commentary and Insight Regarding TSCA Modernization

We hope you will visit our TSCA resources page often and come to view this content as an invaluable guidance for helping understand and comply with the New TSCA.

UPDATE: EPA Moves Quickly to Implement New TSCA, Announces Two Public Meetings in Early August

In a notice published in the July 26 Federal Register, EPA announced two public meetings that will be held to gather information for two important rulemakings implementing New TSCA. One meeting, to be held on August 9, 2016 will address the new "risk evaluation" process for existing chemicals; the second meeting, on August 10, 2016, will address the process for "prioritizing" existing chemicals for risk evaluation.
