As a consequence of the ongoing COVID-19 pandemic, many businesses face mounting disruptions. Among the most significant is the need for many to temporarily shut down, and then restart their business operations when conditions allow. As companies confront these difficulties, they face the added challenge of continuing to satisfy applicable federal, state, and local environmental laws and regulations. Businesses face unprecedented obstacles in maintaining routine environmental compliance measures in the midst of this crisis, including:

  • A lack of staff to collect samples for required testing.
  • The inability to obtain physical signatures for documents such as air permits and compliance reports.
  • Difficulties constructing, repairing, upgrading, and maintaining emissions controls and other monitoring systems due to disruptions within the supply chain or the work force.

What remedies and protections are available?
