The firm’s Energy Group has long-term and diverse experience in navigating the complex issues confronting microgrid owners, developers and vendors.

We have advised clients with a multiplicity of business objectives in developing a microgrid, including having a system capable of operating completely “uncoupled” from the grid, developing a backup system available for emergencies, increasing system resilience or reliability, and securing some or all of the clients’ power needs from renewable resources.

From joint ventures to financing arrangements, we counsel clients on practical ways to structure transactions for financial success. We also have broad experience in negotiating the commercial agreements – such as power and thermal energy purchase agreements – needed for microgrid project development.

Microgrid regulation is a very new and rapidly evolving area. We help clients navigate state and FERC regulatory proceedings, with compliance and efficiency in mind. We excel at guiding our microgrid clients through, and at times shaping, the complex regulatory environment.

Representative Engagements:

  • Represented the Fort Detrick military base microgrid developer in all aspects of system service and power purchase contracts and other underlying agreements, state and federal regulatory issues, and financing for the original facility and then a later expansion.
  • Advised client on transactional, due diligence, financing and regulatory issues in potential microgrid developments and acquisitions, including developing agreements for early stage development, energy sales and construction and operation, and counseling on procurement and financing issues in connection with developing several numerous community microgrid projects in New York, and an industrial microgrid in Texas.
  • Assisted client in developing a storage microgrid in East Palo Alto, California.
  • Assisting a major real estate developer in assessing and implementing alternative energy supply and delivery options, including a planned microgrid, in Maryland.
