Crowell & Moring’s Environmental Justice Working Group brings together a diverse group of lawyers with years of environmental and environmental justice experience, encompassing both our extensive client representation and prior service as high-level officials in the Environmental Protection Agency (EPA) and Department of Justice, Environment and Natural Resource Division. Members of our working group have worked directly in assessing environmental regulations and their potential impacts, having chaired an advisory committee on EPA’s implementation of Title VI, and directly implemented EJ Executive Orders. We utilize our collective knowledge and experience to respond to the emerging regulatory priorities of the Biden administration and its stated intention of advancing environmental justice principles through an all-of-government approach.

Our team understands the uncertainties that the regulated sector and other stakeholders face from evolving environmental justice policies, and we closely monitor environmental justice-driven regulations and initiatives to provide our clients with creative, proactive, and relevant solutions necessary to meet the opportunities and challenges that lie ahead. We provide compliance and regulatory counseling and representation on enforcement actions, investigations, negotiations, and disputes across several sectors, including:

  • Manufacturing;
  • Energy Production, including utilities, renewables, and oil and gas;
  • Petrochemicals, Pesticides, and other Chemicals;
  • Transportation;
  • Government Contracting;
  • Mining and Natural Resources;
  • Technology; and
  • Retail.

We expect the Biden administration to elevate environmental justice concerns and drive a rapidly evolving regulatory and compliance landscape. Our team stands ready to support a broad range of client needs, including:

  • Tracking and monitoring legislative and executive regulatory environmental justice developments;
  • Conducting environmental justice risk assessments, audits, and investigations;
  • Enhancing communication with state and federal agencies regarding compliance with environmental justice policy, regulation, and laws;
  • Developing environmental justice strategies, including in agency and citizen enforcement defense and in pursuing regulatory approvals for projects and operations; and
  • Engaging environmental justice communities as stakeholders in the project development, planning, and approval process.
