More than a quarter of Fortune 100 companies have turned to Crowell & Moring to handle investigations. That’s because we bring together a battle-tested team of litigators, former prosecutors, and regulatory attorneys to craft strategies that succeed and bring clients peace of mind.

Whether navigating a government probe or ensuring compliance with regulations and corporate policies, Crowell & Moring provides effective counsel gained from years of experience, powerful regulatory depth, and a unique approach to creating multi-disciplinary teams that are both creative and flexible. Our work includes broad-reaching investigations on behalf of boards of directors, high-profile and international investigations, internal investigations, Congressional investigations, compliance counseling, and monitorships.

Investigations and Prosecutorial Experience

Crowell & Moring’s Investigations Practice is comprised of a diverse team of more than 40 seasoned lawyers, including a powerful bench of former government prosecutors, former government agency enforcement attorneys, and life-long defense attorneys. Named to the Global Investigations Review’s “GIR 100,” our lawyers have represented clients in matters spanning more than 80 countries and six continents around the globe.

Our team includes leading practitioners who range from one of the original prosecutors on the DOJ Enron Task Force, to the most recent Acting U.S. Attorney for the Eastern District of New York, and more than 20 former U.S. Department of Justice attorneys. The team also includes highly experienced former regulators in key arenas, such as the Inspector General of the Intelligence Community in the Office of the Director of National Intelligence, a former Counsel of the U.S. Department of the Treasury's Office of Foreign Assets Control (OFAC), and the former Chief Counsel of FinCEN. And our partners are among some of the most highly esteemed captains of the bar, such as the former chair of the American Bar Association's Criminal Justice Section and the State Bar.

Regulatory and Industry Depth

Our team understands how industry works and how regulators think. Crowell & Moring has a deep bench of former government agency officials and across its eight offices internationally—from the former Administrator of Federal Procurement Policy at the White House’s Office of Management & Budget (OMB) to the former general counsel of the Consumer Product & Safety Commission (CPSC).

Our team includes lawyers formerly with agencies ranging from the Environmental Protection Agency (EPA) and Securities Exchange Commission (SEC) to the Department of Defense (DoD) and the Federal Trade Commission (FTC). And our practice spans a range of disciplines, including False Claims Act concerns arising from government contracts and programs, antitrust, securities and financial fraud, FCPA and domestic public corruption, export control laws, international sanctions, anti-money laundering laws, health care fraud, and health care regulatory compliance, environmental and energy regulatory compliance, and many more.

A Powerful Approach

We build powerful, multi-disciplinary teams whose approach relies on creativity, flexibility, and results.  We assemble investigative teams across practice areas and geography to ensure seamless  interdisciplinary investigations that bring to bear appropriate subject-matter knowledge and a response proportionate to the enforcement and commercial risk.

Working as a multidisciplinary team, our attorneys bring their longstanding experience to bear on critical matters and leverage best practices in computer forensics, witness interviews, and forensic auditing to launch effective responses and craft disciplined strategies.  As a result, we are able to deal with multiple regulators across multiple jurisdictions, and we regularly serve as advisors on crisis management concerns.

Key Focus Areas

Our diverse, comprehensive investigations team includes lawyers with deep knowledge of virtually every legal issue subject to scrutiny by today’s government regulators and law-enforcement officials. While we are proud of our record in high-profile matters, our best work is often accomplished well under the public radar. We help clients identify appropriate corrective actions and have a proven record of success guiding management and boards to sensible settlements. In many other cases, we are able to convince agency officials to avoid initiating an investigation in the first place.
