As federal, state, and local governments are faced with budget limitations, public-private partnerships (PPP or P3) provide a vehicle for commercial enterprises and governmental entities to join forces and resources in the pursuit of major development and infrastructure projects. Distinct from traditional public-procurement arrangements, P3s enable private-sector companies to finance, build, rehabilitate, maintain, and/or operate specific public-sector activities and initiatives in return for a contractually defined stream of future returns and other compensation.

Crowell & Moring's P3 practice delivers comprehensive, coordinated counsel from one of the industry’s most experienced legal teams. We have helped privately owned and publicly traded businesses alike achieve exceptional results in the state, federal, and international market for these joint initiatives. Over decades of work, we have advised clients on projects that create, develop, and expand a broad range of critical infrastructure and services, including airport and aviation facilities, highways, railways and rail corridors, hospitals and medical centers, public works tunnels, utilities, energy and natural gas generation and distribution, military housing and facilities, stadiums and mixed-use facilities, and schools and universities, among many other engagements.

Our lawyers have represented clients across the United States, Latin America, the Middle East, and Southeast Asia. Our team is similarly diverse; we draw on the talents of lawyers from our top-ranked corporate and securities, energy, environmental, finance, government contracts, litigation and arbitration, public policy, tax, and other practices. We routinely and quickly build client-specific teams that address the unique requirements and challenges of each project. To help smooth the path of cross-border projects, we work closely with experienced local counsel and with C&M International, an international policy and regulatory affairs consulting firm based in Washington, D.C.

Our clients include prime contractors, owners, design professionals, financial institutions, developers, and subcontractors. We provide start-to-finish guidance on issues that arise throughout the lifetime of a project, including identifying development incentives and sources of financing; preparing bids and claims; assisting with transaction structuring; negotiating and drafting contract terms and agreements; and resolving procurement and other disputes through litigation and arbitration.
