For almost 30 years, our team has successfully defended clients from across the country and around the world in connection with investigations and litigation of procurement fraud matters. Our practice spans investigations by grand juries, federal agencies and inspectors general, congressional committees, and other investigative officials and bodies. Our clients range from multinational corporations to closely held businesses, and from CEOs to sales representatives.

What differentiates our team from others is our deep experience across several practice specialties. Our team includes seasoned white collar and regulatory enforcement lawyers who have collectively tried hundreds of cases, working alongside our industry-leading Government Contracts Group. We strategically align our substantive experience in procurement laws and regulations with our formidable white collar litigation and investigation experience, bringing our clients a powerful capacity to analyze, advise, and zealously advocate their positions.

Crowell & Moring's procurement fraud investigations and defense team has an extensive history that covers the full range of federal civil and criminal enforcement. Our practice includes deep False Claims Act/qui tam experience, along with significant experience with the Anti-Kickback Act, Major Fraud Act, export control issues, false statements, Honest Services Fraud, and Mail and Wire Fraud matters. Additionally, our trial experience brings us the judgment and confidence to win in court when informal resolution or settlement efforts have been exhausted.

  • Tried and obtained defense verdict for a globally significant government contractor in a False Claims Act case involving allegations of procurement fraud, with over $1 billion in claimed damages
  • Represented a major food supplier in parallel criminal and civil investigations relating to federal prime vendor contracts
  • Represented a foreign company in parallel criminal, civil, and congressional investigations relating to alleged fraud in connection with over $1 billion in government contracts
  • Represented a client in the successful challenge of relator as original source of allegations that the contractor violated various federal environmental regulations while processing waste at a nuclear weapons facility (United States ex rel. Stone v. Rockwell Intern. Corp., 492 F.3d 1157 (10th Cir. 2007))
