Emma K. Burton is a counsel in the firm's Washington, D.C. office, where she practices in the Mass Tort, Product, and Consumer Litigation and Antitrust Recovery groups. Emma's practice involves class action claims recovery – pursuing and maximizing claims in large antitrust and tort settlements – as well as litigating product, toxic tort, and environmental matters, with a focus on complex health and life science cases. She is experienced in the process by which class action settlements are administered and distributed, and in resolving disputes involving allowable purchases, sufficiency of data, and allocations of funds. Emma’s practice also involves the development, implementation, and management of sophisticated settlement solutions as alternatives to litigation. She is experienced in all aspects of evaluating, designing, and administering multifaceted claims processes to resolve product, tort, and environmental issues.

Representative Matters:
  • Defending medical device and pharmaceutical companies in mass tort litigation and coordinating defense of related product liability lawsuits.
  • Conducted numerous product liability/regulatory risk assessment for medical device companies.
  • Managed a multi-year, complex product claims management process to investigate and resolve tens of thousands of claims alleging property damage from a commercial herbicide.
  • Counsel for a Fortune 100 company in a series of high-profile product cases alleging birth defects from exposure to a major fungicide, including significant toxicology, epidemiology, teratology, genetics, and exposure issues, international discovery and application of foreign law.
  • Defended a major East Coast railroad in complex toxic tort litigation and commercial contract disputes.
  • Representation of a Fortune 100 manufacturer of construction equipment, engines, and turbines as national coordinating counsel in a series of toxic tort matters filed in various state and federal courts.
  • Represented a major railroad in a multi-million dollar commercial contract dispute regarding fiber-optic telecommunications facilities.

Emma originally joined Crowell & Moring in 1997 and returned to the firm in 2012 after an extended leave to focus on her family. She received her A.B. in sociology from Brown University in 1994. She graduated cum laude earning her J.D. from Georgetown University Law Center in 1997, where she was a member of the Georgetown Journal of Legal Ethics.
