Martin J. Mackowski is a counsel in Crowell & Moring's Washington, D.C. office and a member of the firm’s Antitrust Group. Marty represents businesses and executives in a broad range of civil and criminal antitrust matters, including litigation, merger reviews, government and internal investigations, and counseling regarding compliance with antitrust law. He has represented clients in matters involving the Antitrust Division of the U.S. Department of Justice, the Federal Trade Commission, and various state attorney general offices, as well as foreign competition authorities such as the European Commission and Canadian Competition Bureau. Marty has handled matters in a broad range of industries, including energy, aerospace, retail, technology, manufacturing, health care, telecommunications, and financial services. His recent experiences include:

  • Represented AT&T in the U.S. Department of Justice merger review and subsequent litigation seeking to enjoin its $85 billion acquisition of Time Warner.
  • Represented United Technologies in its $23 billion acquisition of Rockwell Collins.
  • Served on trial team defending Humana in litigation brought by the U.S. Department of Justice to enjoin its $37 billion acquisition by Aetna.
  • Represented a major telecommunications firm in connection with an investigation by the U.S. Department of Justice into alleged violations of Section I of the Sherman Act.
  • Asserted claims on behalf of a global technology company in price-fixing litigation and international arbitration brought against manufacturers of cathode ray tubes.
  • Represented a global energy company in a U.S. Department of Justice review of a $2.5 billion merger.
  • Represented a multi-national chemical company in an internal investigation and response to federal grand jury subpoena for alleged price-fixing and bid-rigging.

Marty served as a contributing editor to the ABA Section of Antitrust Law’s Antitrust Law Developments (Seventh).

Marty also maintains an active pro bono practice. He recently served as lead trial counsel in an Immigration Court proceeding where he secured asylum for a client fleeing persecution based on his political activity and opinion.

Marty earned his J.D., cum laude, from Boston College Law School and his B.A., magna cum laude, in political science from Loyola University Chicago. While in law school, Marty successfully briefed and argued an armed robbery case before the Massachusetts Appeals Court, working in conjunction with the local District Attorney’s Office.
