Michael A. Sabino is an associate in the firm’s Insurance/Reinsurance Group in the New York office. Michael has represented and counseled insurers, Fortune Global 100, and international companies in complex litigation, arbitration, and regulatory matters involving the financial services industry, construction defects, products liability, consumer technology, and government investigations.

Michael has advised insurers, insurance syndicates, and reinsurers on coverage disputes and underlying litigations impacting an array of policy lines and coverages, including errors and omissions, directors and officers, fidelity bonds, cyber breach and response, product liability and recall, and environmental. These matters include complex issues of contract construction and underwriting intent; excess insurance and exhaustion; rescission; late notice defenses; allocation; privilege and access to records; and broker liability. He has handled litigations in the federal and state courts, as well as confidential arbitration proceedings.

Michael has also advised clients on securing and maintaining regulatory approvals and licenses to market and sell insurance products; and provides counsel on new liability exposures, regulatory implications, and insurance coverage issues.

In addition to resolving insurance coverage disputes on behalf of domestic and international insurers, Michael has also litigated and resolved disputes on behalf of various funds, private holding companies, construction consortiums, and non-profit entities. Such disputes have involved claims of breach of fiduciary duty, construction defect allegations, patent pool agreements, and government investigations.

Prior to entering private practice, Michael served as a law clerk for the Honorable Leonard B. Austin, Appellate Division, Second Department in Brooklyn, New York, and the Honorable Kenneth J. Slomienski in the New Jersey Superior Court.

Representative Matters

  • Defended an insurance company against a retail company’s claim in U.S. District Court for insurance coverage arising out of the settlement of shareholders’ commencement of appraisal proceedings before the Delaware Chancery Court.
  • Represented insurer of a PRP in coverage litigation commenced as a result of contamination and subsequent mitigation and clean up at an EPA Superfund site.
  • Represented creditor in the recovery of $270 million in customer funds in the Chapter 11 and SIPA liquidation proceedings of defunct investment bank MF Global, as well as obtained a favorable settlement in related civil litigation against former executives.
  • Successfully defended insurers’ assertion of privilege in connection with the management of claims and related coverage issues arising out of D&O and E&O liability policies issued to financial institutions.
  • Counseled insurance syndicates in connection with professional liability and fidelity bond programs underwriting mortgage banking professionals and practices.
  • Favorably resolved employment dispute arising out of non-compete agreements regarding retail industry service provider.
