Thomas P. Gies is a founding member of Crowell & Moring's Labor & Employment Group. Tom has more than 35 years of experience in litigating employment disputes. Tom’s litigation experience includes five jury trials, two U.S. Supreme Court arguments, 18 federal appellate court arguments, and more than a hundred trial court and arbitration matters involving a wide range of labor and employment law issues, including traditional labor law, whistleblower retaliation, EEO claims and wage & hour class and collective actions. Tom also maintains an active compliance counseling practice, involving the full range of employment law issues facing U.S. employers. Tom's traditional labor counseling practice has focused on helping companies develop and implement strategies in situations involving operational restructurings, facility closures, subcontracting of bargaining unit work, and work stoppages.

Tom’s employment litigation experience includes numerous class and single plaintiff cases arising under Title VII, the Equal Pay Act, the ADEA, and the FMLA. His recent litigation experience includes a successful settlement of a class case brought by the EEOC alleging systemic sex harassment. Tom regularly litigates cases involving disability discrimination claims brought under the ADA and state disability laws. He has experience in litigating ADA cases brought by the EEOC, including a recent successful settlement of a case brought by EEOC in Colorado. Tom’s practice also includes representation of businesses confronting novel questions regarding the scope of an employer’s reasonable accommodation obligations under Title III of the ADA.

Tom has litigated cases involving a wide range of ERISA issues, with particular emphasis on fiduciary breach claims and retiree medical disputes. Tom has significant experience in counseling and litigating disputes arising under employment agreements, including trade secret theft and non-compete issues.

Tom is actively involved in counseling companies with respect to COVID-19 matters, including advising on issues arising under WARN statutes, paid leave legislation, state and local closure orders, the essential business definitions, ADA and other EEO issues, and standard of care issues implicated by evolving federal and state regulatory initiatives.

Tom is an active member of the U.S. Chamber of Commerce Labor Relations Committee.

Tom chaired Crowell & Moring's Labor and Employment Group for 20 years. Before joining the firm in 1983, Tom practiced labor law with Seyfarth Shaw in Washington and Chicago.
