Olivia L. Lynch is a partner in Crowell & Moring's Government Contracts Group in the Washington, D.C. office.

General Government Contracts Counseling. Olivia advises government contractors on navigating the procurement process, compliance and ethics, commercial item contracting, accessibility, supply chain assurance, and various aspects of state and local procurement law.

Bid Protest Litigation. Olivia has an active bid protest docket and has been involved in agency-level protests as well as bid protests before the Government Accountability Office (GAO), the Court of Federal Claims (COFC), and the Federal Aviation Administration's (FAA) Office of Dispute Resolution for Acquisition (ODRA). She has represented both protesters and awardees in matters concerning such topics as pre-award protests of solicitation terms, challenges to the cancellation of procurements, sole source awards, exclusions from the competitive range, and post-award challenges. She has successfully negotiated cost claim reimbursements for successful protesters as well as won recommendations for reimbursement of protest costs where the agency took corrective action prior to GAO reaching a decision.

Small Business Issues. Olivia provides advice on all manner of small business government contracting issues, including: certifications as to small business size and status (SDVOSB, WOSB, 8(a), HUBZone); participation in programs of the Small Business Administration (SBA) and other agencies (e.g., mentor-protégé programs and the Department of Transportation’s Disadvantaged Business Enterprise program); and compliance with such requirements as the limitation on subcontracting, non-manufacturer rule, and the small business subcontracting plan requirement. Olivia counsels large and small contractors on these issues in the context of procurements, protests, transactions, investigations, mandatory and voluntary disclosures, and False Claims Act litigation.  Olivia has also filed and defended against size protests as well as litigated size appeals before the SBA's Office of Hearings and Appeals (OHA). 

Paycheck Protection Program. Since the CARES Act established the Paycheck Protection Program (PPP), Olivia has advised on all manner of issues related to this program. She has counseled companies on eligibility both from a size perspective and related to the economic necessity certification. She has also assisted in investigations and disclosures related to PPP loans.

While in law school, Olivia externed for Judge Thomas Wheeler at the Court of Federal Claims. 

Olivia has volunteered for legal service organizations dedicated to representing individuals that have suffered domestic and sexual violence. She has represented incarcerated DC residents obtain parole and compassionate release. Olivia currently volunteers for the DC Volunteer Lawyers Project’s Protection Assistance Project.
