Jan-Diederik Lindemans is a partner in Crowell & Moring's Brussels office in the Litigation and Intellectual Property groups. His practice focuses on litigation for clients that are mostly active in sectors driven by technology, innovation and creativity.

Jan-Diederik is first and foremost a litigator and has over 15 years’ experience defending his clients’ interests in ex parte, preliminary and permanent injunction proceedings, and in accelerated and standard proceedings on the merits. Issues dealt with relate to intellectual property, trade secrets, unfair competition and other contentious matters. Jan-Diederik is also often consulted by clients in pre-trial matters such as pre-trial discovery (saisie contrefaçon), trade secrets compliance and anti-counterfeiting strategy. He further advises in non-contentious matters relating to licensing or transfer of intellectual property, (re)structuring IP portfolios, joint ventures and other types of creative/technological collaboration.

Jan-Diederik represents a wide range of clients, most of whom are active in the chemical, pharmaceutical, and biotechnological sectors, or the advertising, media, entertainment, and fashion industries. His focus is on legal advice that has an immediate impact on his clients’ business (e.g., product recall avoidance or opposition proceedings in relation to access to confidential information).

For his clients in the chemical, life sciences and biotechnology sectors, Jan-Diederik has, e.g., filed protective letters and represented clients in complex patent validity proceedings (often involving cross-border issues). His clients involved in entertainment and the media call on him to advise in negotiations as well as relying on him to defend their various IP rights (relating to e.g., on and off-screen talent, content production and licensing, and collecting societies). For clients in the fashion industry, Jan-Diederik has assisted with their IP portfolios and has represented them in commercial disputes, distribution, counterfeiting matters, search and seizure, and EU-wide or national border measures.

Representative Matters

  • Defended leading pharmaceutical companies in preliminary injunction proceedings regarding generic versions of blockbuster medicinal products.
  • Defended a multinational active in the sweetener industry in ‘bet the company’ all-or-nothing third party opposition proceedings against a direct competitor involving six appearances before the Belgian Supreme Court.
  • Executed the largest counterfeit seizure within the Benelux area on behalf of a producer of animal feed additives and upheld the client’s patent and trade secret rights in proceedings on the merits.
  • Initiated cease and desist proceedings against a multinational electronics manufacturer for breach of the terms of use of advertising material produced by the client.
  • Brought proceedings against the tabloid press on behalf of a well-known performer and his family in connection with the unauthorized use of images.
  • Defended shoe manufacturers against copyright and trademark claims by competitors relating to both orthopaedic and high-end luxury shoes.

Jan-Diederik joined Crowell & Moring’s Brussels office in 2004 after working for a Brussels-based IP boutique law firm for several years. He is a frequent public speaker and the author of various publications on IP and judicial law. He was actively involved in the debate concerning the revision of the EU directive for trade secrets, and has closely monitored the developments concerning the Unified Patent Court.
